I am a native of Texas who traveled extensively as a child. Such is the life of the children of military families. I married my Marine, CWO4 Pascual Valdes, in 1981 and again started moving about every 2 years. Pascual served his Country and his Marine Corps well and passed away in March 2008 a mere three months after retiring.
I have lived in Jacksonville, NC for over 16 years now; our children were born coast to coast (California, Texas, North Carolina) all are grown now but still remain in the area.
I received my real estate license in 1997, have a background in finance and marketing, as well as first hand experience in military moving. I have been a top producing agent since my first full year in real estate; the recipient of numerous awards, and am an owner of VIP Realty Group.

Ask the builder to issue the check to the real estate attorney so that it can be held in escrow. Any attorney whether it is his or yours so long as it is in escrow. To say, "Do not move forward" may not be a good idea ... to totally not move forward may put you in breach of contract ... in that case you will lose your money. Better to discuss your concerns with the builder and reach an agreement to move the funds to one of the attorneys. - Fri Aug 8 2008, 12:47
If you are asking if the realtor/owner has broken any rules regarding removing his home from an active status in the MLS ... no he hasn't.
The lender on this home sets no guidelines for the homeowner in the sale & marketing of his property. The home is not a foreclosure, the owner is just behind on his payments and may at any time negotiate with them to retain the home if he chooses. In this case he has chosen to negotiate the sale of it with both the lender and a prospective buyer.
If he has found a ready, willing, and able buyer who has offered up an acceptable offer is prequalified for a home loan, why would he not accept the offer regardless of whether or not it's the first offer?
The home may be in the MLS but in a sale pending status. A sale pending status often won't pull up in home searches because it is no longer active.
The real estate sign will typically stay in the yard until actual deed transfer.
You may put in a "back-up offer" if you wish. A back-up offer would fall into place only if the first offer were to be terminated for whatever reason. - Fri Aug 8 2008, 12:26

Use the national average given by CNN of 5%. Interview agents that have experience and know the market. Your listing percentage should in part be based on what the housing competition is on homes comparable to your home. A Realtor will explain to you how the amount you pay will be co-brokered out between a buyer's agent and a seller's agent. Be competitive on your price and co-brokerage percentages. Get the marketing edge from all angles to beat the competition ... competition being other homes both preowned and new construction. - Fri Jun 27 2008, 13:14
