for$254. now the bank is not holding up to thier end in doing the well/septic inspection. it states in the contract by the county health dept. or mutually agreed upon private company. HOWEVER we did not agree to whom they hired we wanted the health dept. can we hold them to pay back our $254. since they broke the contract? greenville, mich.
Brian many companies are certified by the health department. So you may want to check and see if the company they used is. In our area many of the inspectors gete certified by our health department, which actually moves things along quicker. But as others said check with your agent and see why they used the company they did.

Brian - I think I may need some more info before I can respond with any help. The bank states in their contract that they will pay for the well/septic inspection? Or is your lender requiring the inspection for your loan? If you are wondering what legal rights you may have your best bet is to speak to a real estate attorney. I can tell you from experience that banks are not the easist sellers to work with. Have your buyers agent go over the contract with you to clarify any items that you don't understand. Good luck!
What are your issues with the company that they hired? How did the inspection turn out? I would talk to your Realtor (I hope you are not navigating an REO by yourself....it will cost you MORE in the long run) and find out why you were unable to approve the company they used. Let your Realtor guide you. Also...the banks often issue contracts that supercede the original purchase offer......did they do so in your case? If so...read that contract carefully....your answer will be in the document.
